By accessing or using the software, applications, or services, you agree to fully indemnify, defend, and hold harmless the developer and any associated companies, and their respective owners, directors, officers, employees, contractors, agents, successors, and assigns, from and against any and all claims, demands, actions, proceedings, liabilities, losses, damages, penalties, fines, judgments, settlements, costs, and expenses (including legal fees on an attorney-and-own-client scale, where permitted) arising from or relating to: (a) your access to or use of the software, applications, or services; (b) your misuse or inability to use them; (c) your data or content; (d) your violation of any law or third-party right; or (e) any breach of these terms.

You agree that the developer may assume exclusive control of the defense of any matter subject to indemnification, and you will cooperate fully with such defense at your own cost.

To the fullest extent permitted by law, you irrevocably release, waive, and discharge the developer and any associated companies from any and all claims or causes of action, known or unknown, arising from or related to your use, misuse, inability to use, or reliance on the software, applications, or services, and you covenant not to sue or initiate legal recourse against them in connection with such matters.

If any provision of this policy is held unenforceable, that provision will be interpreted to the maximum extent enforceable and the remaining provisions will remain in full force and effect. All indemnities, liability exclusions, waivers, and releases survive suspension, termination, or discontinuation of your use of the software, applications, or services.
